Am I eligible?

Hi all

My Tier 1 (General) visa expires on 8 May 2014.

This is my scenario - my current/prev visa are as below

Initial - 25 Jun 2009 to 25 Jun 2012 (I have travelled to the UK on 30 Aug 2009 - which is within the allowed 90 day limit)
Extn - 08 May 2012 to 08 May 2014

The question is am I eligible to apply for ILR 28 days before 8 May 2014 ?

I wouldn't have completed 5 years on 8 May 2014 as my initial entry was issued from 25 Jun 2009. Do I have to apply for another extension before I can apply for ILR?
Any response on this is highly appreciated

You can apply up to 28 days before 25 jun 2014 . For PEO application you need an extension. You can apply in post and vary . You can search forum on varying application.

Thanks for the response

My husband is on ILR at the moment. If I opt to go for a dependant visa now will I get a visa valid for 10 years? Or just for 2 years?

If you switch to ILR spouse visa on FLR(M), your clock will reset and you will have to complete another 5 years before you can qualify for ILR. If you switch to FLR(M), you will be granted a visa for 2.5 years and will have to apply again on FLR(M) for a further 2.5 years. There is a financial requirement you/husband will have to meet for this visa.

You would do better to do as advised to apply by post for a T1 extension and when you meet the 5 year requirement, apply to vary the application on Set(O) ILR.
