ILR application and council housing.

Hello all,
I'm British and my wife is here on a spouse visa, due to apply for ILR in November of this year. We've recently had a child and as such, we have become eligible for social housing (according to our local council). They have all the details of my wife's immigration status.
If we take a council house, would this affect my wife's ILR application in any way? Her current visa does say "no recourse to public funds" but my local council says that we are eligible due to myself and my daughter being British. But I was wondering if UKBA might get funny about it come the time of the application.
Thanks in advance.
Darren

Hi Darren,
Welcome the forum!
If your local council states that ‘You, your wife and your child’ are entitled to council housing, they possibly have not considered whether your wife is on a spouse visa. As your spouse’s visa specifically states that she should not have any recourse to public funds (this is black and white), she should unfortunately not claim benefits in any shape or form. This may hinder her ILR application.
What I can suggest is for you to ask your council -> if you and your child (without your wife) are eligible for the housing benefit. Alternatively, apply for council housing once your wife has been granted ILR.
Hope this helps.

You can only be allocated Council housing as a single person (+ child/children).
