Hi,

If the tier 1 general migrant got ILR without his family who are with him since day one. What form the family should use to apply for ILR. Is it Set(M) or Is it Set(O).

If it is set(O), does the spouse to be filling the first page of application and then put the details of dependents on the next page OR his husband(now settled in UK) has to fill the first page.

I am really confuse. Please help me out.

I can't find any advise on UKBA website or even on this forum. May be my situation and case is different.

So I have to fill my details on the first page, my children details on the 2nd page, my immigration history on the relevant pages and than where I have to fill the details of my partner who is now settled in UK? This is the only question confusing me. Which section in section 11 to be ticketed, as there is nothing saying PBS dependents.

Tier 1 dependent details as main applicant and children details in relevant section. Section to tick is 'other'.

There should be a part of the form to fill in your spouse and his ILR details. You will need to submit his ILR BRP, passport and your marriage certificate anyway and the UKBA have all his details on their system too.

There is no section in form for the spouse details as advised by you. Can you please refer me to the relevant section. However, in Set(M) form there is this type of details. Since, I am planning to book the PEO appointment for my case, therefore I will take all the relevant documents advised by you.

As you are the main applicant, you will be fine with only your details and children details on Set(O)

You cannot apply using Set(M) as you are a Tier 1 dependent and not on a spouse settlement visa Flr(M)

Why didn't you all apply at the same time for ILR??

It was the worst mistake we have done. So how will I prove that my hubby was my main applicant, as there is no mention of his name on the form.

They have all your details and your PBS dependent visa will be directly linked to him. Is he going with you for your PEO appointment?

I am in the same situation. My husband got ILR after comleting 5 yrs on Tier1. I am on tier1 dependant. I did not apply for ILR at the same time as him because I had not completed life in the UK. Now I have all the documents to make the application.
SET O is very confusing for dependent application. If the dependent fills in the form as though he is the main applicant(thereby filling in section1) then where do you provide details of your spouse who is the ILR holder.
Also for the questions on home and finance (section5) what do you answer for "are you working in the UK"and pay details if the dependant is not working and reliant on the ILR holder.
Section6 Immigration history- whose details does one provide - the ILR holders (who already provided all this at the time of his application) or details for the dependant .
Section 10 Biometric: whose details does one provide.

It is very confusing if someone can provide guidance would be much appreciated
