Hi
I am a ILR Holder and My wife is having extension on my previous Tier 2 Status.
Am I ok to submit SET(O) form for her, as She has a Permit as "PBS DEPENDENT LEAVE TO REMAIN"

Can anyone confirm the SET(O) is the form for the "PBS DEPENDENT ILR" Applicant?

Thanks,
Nisarg S

Hi

I am a ILR Holder and will be eligible for British Citizenship in June 2014

My partner, is PBS dependent at the moment (until June 2015), but she will eligible for ILR in June 2014.

Can you pls suggest, what is the better option :

Should I wait for my Citizenship until June 2015 & Complete my partners ILR with 1 Year require period for her Citizenship?

OR
Should I go ahead and complete mine Citizenship and go for her later?

Also,

Is she eligible for Citizenship directly after completing her 3 Years time under PBS Dependent (if I had my Citizenship in June 2014)?

Pls advise,
Thanks,
Nisarg s

Will make no difference which route you choose.
Your citizenship and her ilr and her future citizenship have no bearings.
In simple terms, she has to apply for ilr when she is due, 12 months after ilr, she can apply for citizenship if she so wishes!

Yes, SET(O) is correct for PBS Dependent ILR application.

If you apply in June 2015, then as soon as your wife get ILR and has 3 years residence in the UK, she can apply for citizenship as spouse of BC. There will be no need to wait 12 months on ILR, but only if she has been resident for 3 years and meets the standard requirements.

Any legal stay (visas) can be used towards the 3 years residence.
