Query for ILR Dependent

Hello
Currently I am in dependent visa (spouse)
I came to UK in Dec'11 as a work permit dependent.
, the validity was until Sep'13. My husband was in work permit visa . On Sep'12 my husband has got ILR. I had to extend my visa on FLR Category on Sep'13.
I believe now I am eligible for ILR. I am confused
between two forms which needs to be used. SET(O) or
SET(M). As my husband has got ILR on work permit
basis, the form which we believe is SET(O)

Can anyone confirm it please?

Why did you extend if it was a work permit, you could have applied for ILR with him?

If you switched using FLR(M), it would be SET(M).

Not for a work permit, no. The two years applied to PBS deps.

Hi,
Thanks for the reply.
But in the new UKVI website it says SET(O) for ILR dependent whose sponsor( my husband) has got ILR through 5 years work permit.

Now I am the main applicant.My big confusion is, there are no details asked about the sponsor. As we are not applying together, I need to show his employment, financial statements. But no where in application I can see the sponsor detail needs to be given. Where do I give all the details?

Could you please let me know, if you know about it.

Yes, Last year I had extended through FLR(M) and got visa until next year.

Then settlement must be on SET(M) at first instance now by virtue of rule 287(a)(i)(d). B1 English and LIUK required.

Hi,
I have just gone through the SET (M) guidance. It says

"If you are applying as a partner of a person who
last had leave as a Work Permit Holder, a Relevant
Points Based System Migrant, on the basis of UK
Ancestry or in any other temporary work related
category and they now have indefinite leave to
remain or have been granted naturalisation this is
not the correct form to use".

Yes I have done life in the UK and got certificate from
That my degree was taught in English. Am I eligible to apply for ILR?

I was work permit dependent for 1 year and ILR dependent for another 1 year. So 2 years have been completed.
Can I apply using FLR(M)?

You would need a NARIC statement of comparability (with the letter to show the medium of instruction for the degree was English) or 30 points for qualification and 10 points for English Skills as per the PBS calculator. If you have that then you should be able to apply for SET(M) by virtue of 287(a)(i)(d).
