ILR for Tier 1 G - Mar2010 + Tier 2 (ICT) -Jun2009

Hi,

I am planning to apply for ILR however have some doubt due to the below comment in HO page. I came UK in Jun 2009 as Tier 2 (ICT) while got Tier 2 (ICT) stampped in Feb 2009.

Later I switched to Tier 1 (G) in Mar 2010 and from then I am holding Tier 1 (G) visa. In short, I am about to complete 5 years in UK (Jun 2009 to Mar 2010 as Tier 2 (ICT) and further as Tier 1 (G)).
Below comment says that the 5 years stay can include time in UK on another visa from the list given however this list does not have Tier 2(ICT).

Would appreciate if someone may clarify it as I was under impression that I can apply for ILR in Jun 2014 as I am about to complete 5 years (no matter it was initial 9 months as Tier 2 (ICT).

Continuous residence
The time you’re in the UK is called continuous residence. You can only be outside the UK for up to 180 days in any 12 months during that time.

The 5 years can include time in the UK on another visa if it was 1 of the following:

Tier 1 (General)
Tier 2 (General)
Tier 2 (Minister of Religion)
Tier 2 (Sportsperson)
Highly Skilled Migrant Programme
Work Permit
Innovator
Self-Employed Lawyer
Writer, Composer or Artist

Thanks
Manish

Hi Manish,
Could you please give the URL from where you have extracted the above text. I didn't find it in the below continuous period calculation guidelines:

Hi,

I found it from below page after selecting ILR using Tier 1 (G).

https://www.gov.uk/settle-in-the-uk/y/y ... -1-general

I know people who got ILR using Tier 2(ICT) + Tier 1 (G) + Tier 1 (G) Extn in past but the recent remark over HO page confuses me. Are they not considering the initial Tier 2(ICT) in calculation of 5 years as eligibility for ILR now while were considering earlier?

Thanks
Manish

Ah ok, I can see that. However, it looks like HO guys missed to include Tier 2 ICT (granted against the rules in place prior to April 2010) during the upgrade of their web site recently, because it contradicts with the information in the "Immigration Rules" document available in the below URL, please refer to page #s 8 and 9.

Hi Experts,

Do you have something to highlight here as HO page contradicts the information they have supplied under 5 year guidlines.

Hi Guys,

I have submitted the contradiction details under section "Is there anything wrong with this page?" on page https://www.gov.uk/settle-in-the-uk/y/y ... -1-general.

In the mean time, do anyone have any experience in this regard.

Thanks
Manish
