ILR Eligibity with Adsence in UK

Hello,

I am writing this in order to seek some experianced/experts assistance on my eligibility for UK ILR Visa.

I was first entered into UK on 04th of Jan, 2009 and went back on 15th of Mar, 2009. I returned to UK again on 26th of Jan, 2010 and continued till now, but had a little gap of 65 days in between. There is a major gap of nearly 10 months between my first and second entries. As of I know, I can be eligible only from the date of second entry that is 26th of Jan, 2010 which means I have to wait till 25th of Jan, 2015.

But, I heard from some of my friends and read a few pages in this forum which says about the split of the gap accordingly to reduce the number of days.

Can anyone please suggest me if I can be eligible well before 25th of Jan, 2015?

For example, consider the case if I apply on 20th of Aug, 2014, it would be lessthan 180 days gap in the fifth year, that is from 20th of Aug, 2009 till 26th of Jan, 2010. Would it be a valid scenario??


My UK Visa Details are:

Type of Visa - Valid From - Valid Until
1. Work Permit - 04-Jan-2009 to 03-Jan-2011
2. T2 ICT Long Term - 15-Dec-10 till date



My UK Stay Details are:

UK Entry - UK Exit
04-Jan-2009 - 15-Mar-2009(WP)
26-Jan-2010 - 04-Nov-2010(WP)
08-Jan-2011 - 29-Oct-2011(T2 ICT)
21-Nov-2011 - till date(T2 ICT)

So long as you split the periods so that no 12 month period has an absences of 180 or more. That should be acceptable.

Thanks for the information Amber_. I have another question on the similar lines. I had to go back to India and change the visa type to Tier 2 ICT before my work permit expires on 15th of Dec 2010. Would it have any impact?
