Hi,

I got my ILR ( 5 years on WP/ Tier1 --> PBS route) in Nov, 2012.

1. My wife has been in the UK (as PBS dependant) since April 2012 and we're considering applying for her ILR using SET(O) application form. I was under the impression that she only needed to complete 2 years for her to be eligible to apply for ILR... However, reading Amber's response above, it implies she'll only become eligible next year. Can someone kindly clarify?

2. In SET(O) application form, I can't figure out what box to tick in sections 11(B) to Blimp....And 11(S) seems to suggest that one of those boxes needs to be ticked.
Can someone shed some light on this please?

1. As your spouse was granted PBS dep leave before July 2012 and you settled as a PBS applicant, she only needs 2 years as a PBS dep. Thus, she can apply now, B1 English and LIUK required.

2. None of that section needs completing.

I fear the case worker might ask for the same documents that prove we're married and that I have enough funds (and a job) to support my wife.

Also, in Sections 5.1 to 5.3 (Home and Finances) I entered my wife's earnings (simply because 5.3 asks that question directly). Therefore, even though she may be a dependant, I am obliged to submit the proof of her finances in Section 11A.

Have I got the list of supporting documents right please ?

My documents :-
1. Last 3 Salary slips
2. Last 3 months bank statements
3. Proof of employment ( reference letter from the employer)
4. BRP ( the ILR card)
5. Passport

My wife's documents -
1. Last 3 Salary slips
2. Last 3 months bank statements
3. Proof of employment ( reference letter from the employer) and P60
4. BRP
5. Passport
6. Proof of Address ( Council tax bill, Tenancy agreement and a utility bill)
7. Marriage Certificate
8. LIUK Certificate
9. NARIC Certificate of comparability

Cohabitation proof since last extension up to a max. of 2 years.
