ILR application after 2 years on spouse visa

Hi,
Can anyone advice me for my wife ILR application due to be made in July 2014 ? She arrived on spouse visa in July 2012 as per old marriage visa rules ( 2 year route) and we now need to get ILR.
My queries are -
(1) What's the correct application form for spouse ILR ? Is it SET(M) or SET(O) ? She is spouse of british citizen.
(2) When can we apply for ILR ? Is it 28 days before the expiry date on visa or 28 days before the completion of 2 years probationary period ? Her visa expires in October 2014 but she is completing 2 years in July 2014.
(3) Financial requirement-
Is there any guidelines for financial requirement for ILR as per old 2 year route- spouse visa ? I have just lost my job this month and my wife hasn't found any job for last 2 years. Do we need to show income/job to get my wife's ILR ? Is bank savings enough as we are currently looking for job ? How much bank saving is required ?
I think we won't have any problem for the other requirement like cohabilitation etc.. We have enough documents for this.
I will be grateful if someone advise me.

The new financial requirements are not relevant to you under the old rules. Not 100% sure, but savings should suffice and proof of adequate accommodation.

At the time of application, we won't have the income or job to show as I have just lost my job. Will it means we won't be able to meet the requirement ?
What are the options to meet financial requirement ? My employment history/income has been good but unfortunately I have just lost job and will take sometime to find the next job. We are due to apply in July 2014.
Is bank saving of £10k enough for maintance/finacial requirement ?
Please advise.

The savings and claiming JSA should suffice.

Hi Amber,
Can you also advise on English language requirement for SET(M) ?
My wife has passed life in the UK test and has got master degree (MCA) which was taught in English. What type of documents we need to show ?

If the degree is awarded 20 or more points for qualification and 10 points for English Skills on the PBS calculator a print out should suffice B1 English in addition to LIUK.

Hi Amber,
I will be making an application soon and wants to confirm below queries.
(1) My wife visa state - Spouse visa CP. I was settled person when she got spouse visa under 2 year route. Is SET(M) correct form ?
(2) Regarding income source, my wife has just started a job from this month so we don't have any pay slips to show. Are job offer letter and contract of employment sufficient to show income source ? I will also have last 6 months bank statements with bank savings £14k to support application. I am not working at the moment and looking for new opportunity.

1. Yes, 2, savings should suffice.

For English language requirment, do we need to submit marksheets with degree certificates ? We will have the print out of point based calculator anyway.

I am Spencer from Uganda and have been married now for over 6 years. I got married to an Estonian lady in Italy on 12 August 2008 and we were living together there. On April 2011, she (my EEA wife) came to the UK and started working immediately. I the non EEA spouse later joined my wife and kid here in the UK on Feb 1012. I applied for a residence card and I got it on Aug 2012. My wife became pregnant and later on took a leave of absent from her employer and then went to her country (Estonia) on Oct 2012. She then delivered a girl child there and came back to the UK only on Sept 2013 (Approx 11 months). Even as she came back, she has not been working and now she is pregnant again. This time, the pregnancy is so complicated as the doctors here says there is a very high chance of down-syndrome, so she has gone back to Estonia where she might deliver there. So, I want to ask a few questions as follows:
1) She has been on and off from the UK for almost 2 years without working. Will her absence from work affect my application for Indefinite Leave to Remain (ILR) ??
2) Her on and off from the UK, will it affect my application for ILR)??
3) As she has been absent from work for 2 years due to pregnancy, is she still exercising the treaties rights?
4) I have been working, but I don't know if I have lost my rights as a spouse of an EEA citizen.
I seriously wait for an answer so that I can know how to prepare my application, Thanks
