Tier 1 (General) Dependent length of stay outside UK

Hi,

I have been granted Tier 1 (General) visa in July 2010, my wife joined me as a dependent of mine in October 2010. We are due for our ILR next year in July 2015. She stayed with me in UK from October 2010 to March 2013 but then she was out of UK from March 2013 to March 2014 for a year. She got TB while abroad and was under treatment (We have got all the hospital reports etc) She came back to UK in March 2014 after her treatment. As she is Tier 1 (general) dependent, will this stay outside UK affect her ILR application? I have heard about some 90/180 days rule but does this rule apply to dependents as well?

I would very much appreciate if somone could answer to my query and thumps up for the good work you guys are putting on here.

She should be fine, supply proof of medical issues whilst abroad. I assume her leave never expired whilst abroad.

Many Thanks Amber for the quick response. No, her leave never got expired. she had got the visa extended till November 2015 before she left UK. I was just concerned about the lenght of time she had to stay out of UK for treatment. Do you recommend us applying together for ILR next year or as seperate applications? One of my frined suggested to apply as seperate applications. According to him, if her ILR got refused, they will refuse mine as well as they take the case as one application.

I can't see an issue if you apply together, supply proof the relationship was subsisting (click) whilst she was in India and proof that she needed to stay there for medical reasons.
