Tier 2 (ICT) Long Term Dependent to ILR

Hi All,

My complete my 5 years in November 2014 and will be eligible to apply for ILR as a main applicant 28days before.

My wife's case is a it challenging, she has been in and out of UK and since her last entry, she has been here continuously for less than two years. For cohabitation, she and I have held an active joint bank account since mid-2010.

Our history of entries and visas are as per the attached image.




Could you please advise:

[*]Can my wife apply for ILR along with me 28days before I complete my 5years
[*] Based on her visa and entry history, does she need to show cohabitation with me for 2years or more ?
[*] If she needs to show cohabitation with me for 2 years, will it start from 1st June 2012 when she first entered UK on her last visa (she has had an extension from within UK since then) or from 28th February 2013 since when she's been staying here in the UK continuously ?

[*]Can we apply for my son's naturalisation after I get my ILR as he was born in UK in 2010 ?

Yes, cohabitation proof for the last 2 years.

Yes, the child can be registered under section 1(3) once you're granted ILR.

Thanks Amber. Does her 2 year period start from 1st June 2012 or 28th Feb 2013 ?

Hi bvs,
Please let me know the outcome and the documents provided as I am in the same situation as you are. I will be eligible in feb 2015 and my wife has also been in and out of UK though the first entry was in 2010.
