Hi All,

I had entered UK the first time on the 25th of May 2010 but then had gone back for a couple of months to enter back on the 6th of August 2010 (i.e. within 90 days).
All of the 5 years period from the 25th May 2010 have been less than 180 days outside of UK.
Given the same, Can I go for applying for my ILR on the 27th of April 2015 which is 28 days less than 25th May 2015 ? (calculated using - http://www.timeanddate.com/date/dateadd ... &aw=&ad=28)

Please can you double check and confirm my understanding !

Cheers,
Sudy

Holders of Tier1-GEN/T2ICT are indeed eligible to apply 4yrs11months before the 5year end.
the start date of the 5yr period is from the date stamped on your passport. This is the speical date which, instead of stamping on the passport sheet, is stamped directly on the visa viginette. Instead of cutting it exactly on the 4y11m date, I woud give a week more just to be on the safe side when going to PEO.
As long as the total absence is less than 180 days you should be fine. Write a letter explaing the reason for absence (search for many such letter templates here in the forums).
If you need more help you might have to give some more information on what visa did you enter ? was it Tier2-ICT or Tier1-GEN or PSW

Thanks for the reply !
I entered on Tier 1 General (always been on this) and the date stamped on my visa viginette in the passport is 25th May 2010 which I used as the basis for calculation - i.e. 28 days less than than the date on which I complete 5 years in the country (25th May 2015).

Yes 180 days in any 12 months. Not total in 5 yrs.
