My query is regarding ILR by legally being in UK for 10 years, I arrived in the UK on 17-09-2005, visa valid from 13-09- 2005. my current Tier 2 general issued on 6-09-2012 expires on 5-08-2015. Can I apply for ILR 39 days in advance, so at 9 years 10.75 months from the first visa issued on 13-09-2005?

Thanks in advance.

The rules are quite clear that you cannot submit an application more than 28 days before reaching the required residency.

Your residency for an application based on 10 years long residence counts from the date of entry, not the visa start date. You qualify no sooner than 28 days prior to 17th September 2015.

Thanks for your reply.
In this instance what are my other options?
How do I bridge the gap of about 15 days?
IMO the last Tier 2 visa issued is a bit odd to start in Sept but end in August. Why give a visa for 2 year 11 months rather than a round figure of three years.

what the esteemed colleague means to say, you have to apply for something else before your leave expires, thereby extending it, stall with payment and biometrics, and then vary application to ILR on 17th september

also, the reason your last tier 2 had odd validity, must have been in the validity of your new CoS which is whatever the employer put there -- and the time of your application relative to that Cos. tier 2 is issued with certain set validity periods before/after the Cos.
