ILR Tier 2 - Speeding/Fixed Penalty Notice

Hi,

I am little bit confused with the questions 7.1 and 7.2 in SET (O) Version 05-15 form for ILT for Tier 2 Migrant.

Question 7.1. Have you or any dependents who are applying with you been convicted of any criminal offence in the UK or any other country?

Section 7.2. asks to declare the conviction is there is any. There is a note below which states “We will carry out criminal record checks on all applicants and dependants. You must give details of all unspent and spent criminal convictions. This includes road traffic offences but not fixed penalty notices (such as speeding or parking tickets) unless they were part of a sentence of the court. This includes all drink-driving offences”


I have received a fixed penalty notice (FPN) for speeding at a temporary speed zone (50kmph) on a motorway recently. I have paid £100 immediately after receiving the notice and I got 3 points on my licence.

I have a doubt whether is this considered as a criminal conviction?

Section 7.2. clearly says FPN (such as speeding) need not be declared. So, my response to question 7.1 is “NO”. is that correct?

Could anybody help me on the above questions?

Just to clarify further on my above query, the FPN is issued by Police not any court.
