can I apply for ILR on long residance basis (10 YEAR BASIS)

Dear friends
I have a question hopfully some one can help me with this,
I entered the UK on 4th january 2005 my visa was issued on 16 december 2004, then I extented my visa 2007 and another extension 2009.in 2012 I applied for entrepreneur visa which was refused because of the bank statement , I applied againt the home office decision , the lower court verdict was in my favour , than the home office appealed againt the lower court decision , tha matter went to the upper tribunal home office won the case.than I appealed In the hight court .
1-can I apply for ILR on long residance basis ?.
2-since my case is still with the home office , is the time I spent on appeals from 2012 count towords my 10 year application.

you provided incomplete informtation with regards to your appeals and dates

you applied for Ent visa back in 2012 which was refused(date?) your appeal went allowed(date?)Homeoffice lodged appeal that led a court to hear the case(date?) Home office appeal allowed (date?) you applied to appeal in higher court (date?)

where is your case standing now ?

time that appeals take is counted towards long residency and depands on the nature of the decision your refusal relates in case if you used deception to obtain a document from Secretary Of State

thanks for your reply

1: there is no deception on me any more
2:in December 2013 the court make decision agaibt me so apply for the EE residence card which was also refuse in March 2014 stated that the wages slips and bills i submit with my document in not genuine .
last week my hearing after 2014 refusal which i show the employment letter ,confirmation letter , confirmation of wages slips,bills and also interview now i am waiting for the result but i case some goes wrong should i go for long residence 10 years bases or not
the question is since 2013 till now this time will count or not which was in the home office

On what basis did you apply for this? Who is the EU national, you or a partner/spouse?

I apply through my partner she is ee europe member

If I apply under 10 year basis, will HO still go through Ties 1 Gs or any other applications made in the past?

The 10 year option also requires proof that you were legally residing in the UK, in your case, under the EEA regulations for the entire period, subject to acceptable absences. If you can show this, then you may as well apply for confirmation of PR, as it's cheaper.
For 10 years ILR, HO still checks everything in your immigration history, including tax and declared earnings etc and you will need to provide all the relevant EU treaty rights documents if you are using time spent in this route.
