ILR after 6 Year Discretionary Leave.

Hello There,

I want to make an application for ILR on 2 x 3 years discretionary leave to remain.
Pls All I want to know is that can I go for a same day services instead postal.

Yes Daniel, you can as (official guidance) - "you’re applying to settle in the UK after 6 years discretionary leave"

Hi MDaniel, i used PEO to apply for ILR (6yrs DLR) last month and was granted. I received my biometric card after three days. Followind documents submitted:

First and second home office letters (copies)
Old and new passport with BRP card
6yrs P60 ( If applicable)
Six Utilty bills cover 2yrs e.g gas bill, water bill, electricity, car or home insurance,council tax letter, ect
last three months account statement
last three months payslip
Employer letter (To whom it may concern letter)
Include spouse document and children Uk birth certificate (If applicable).
Above documents must be original with copies

SET O forms with Printed Payment sheet and Appointment letter for PEO
ILR PEO fees: £1900
Covering letter: spectify the initial grant date and the extension date making 6yrs.

Note: Initial grant date: 15-09-2009 but i applied b4 DLR visa expired
Extension grant date:from 26-05-2013 till 25-05-2016
6yrs DLR: 15-09-2009 to 15-09-2016
28 or 29days qualifying period : 19-08-2015 (ILR granted)
i applied 29 days before completing of 6yrs on DLR
Note: makesure you declare all spent and unspent conviction on the Set O forms.

Thanks for creating this post. It is really helpful info here.

I fall under this category & my ILRis due in june 2016. As i read online on gov.uk website it says im not allowed to use the premium service to apply for ILR due to DLR for 6 years (3×2). How true is that? Do i have any options here?
Any advise will be helpful!

You may have misunderstood the official guidance:
You also can’t use the premium or super premium service if you’re applying for discretionary leave to remain or humanitarian protection unless:
you’re applying under the transitional arrangements to extend your discretionary leave after 3 years
you’re applying to settle in the UK after 6 years discretionary leave

I never read this carefully, so you are telling me I'm actually eligible to apply same day service or window service?

If you're applying for ILR after 6 years of discretionary leave you can use the Premium 'in person' service.

hi every one.i granted 6years leave to remain in octobar 2010 and second one got in october 2013.can anybody tell me which documents i need to apply indifinate leave to remain in 2016and can i do same day service plzz.thanks

Hello everyone reading this site has been helpful and I realy hope someone can help me.
I was granted DLR in 2009 for 3 years and again in 2013
My expiry date is 2016
Is it possible to applie early as I have already completed my 6 years already?

PS. They waited a whole year to grant me the second 3 years so technically I will be doing 7 years by the time it expires
Any help will be welcomed

KERRI, i think you are in the same boat as me as mine took almost 6 months for the 2nd DLR. Mine is due in June and i would be applying in May 28 days when it is due!

Hi friends
I have been reading the posts about ILR after discretionary leave. Could someone please help me on few points please ;
I had first extension (on the basis of family life in uk)in 2009 (2009-2012) and 2nd extension was applied in time but it took one year to grant me 2nd extension which was from 2013 to 2016 instead of 2012 to 2015.
Question ; can I apply in 2015 when six years of discretionary leave completes?
As in Set (o) form which is approximately of 80-82 pages do I need to attach all the pages or I can attach only those pages in my application which are relevant to me. As there are so many pages for each category to fill in and the pages(categories) which are not relevant to me can I take those pages out of my application.
If I apply to submit application in person (premium service) do I still need to fill the payment form as a part of application ?

Do I need to enroll for biometric again as a part of application as I already have a biometric residence permit ?

And what are Health surcharges when do you pay this surcharge as I don't find any option to pay health surcharge?

HI FOX , Im married with British so what should i put in to section 2 on set o form where they ask about dependent who are applying with u fill this part , should i put my British partner details over there ??

Hi ca4kmu, because your wife is british and she is not applying with you. You leave BLANK. But makesure you add all her documents both original and copies. Kids document if applicable.

Today makes 6 years I'm on discretionary leave to remain home office took 9 months to make decision. Current visa expires July 2016 isit ok to apply for indefinate now although visa expires next year.
