ILR Application Elligibility 28 Days Rule

I got tier 1 on August 2010. I came England after more than 90 days on 17th January 2011.
Can I apply for ILR Set O application as Premium service on 21st December 2015? I have checked ILR ukba document from page 19 to page 27 but my query is not resolved by reading that.

Can I apply on 21st December 2015 ? And 5 years absentees will be following??

21st December 2010 - 21st December 2011 Year 1
21st December 2011 - 21st December 2012 Year 2
21st December 2012 - 21st December 2013 Year 3
21st December 2013 - 21st December 2014 Year 4
21st December 2014 - 21st December 2015 Year 5

No. You can't.
As you said is gap is more than 90 days.

You can apply no sooner than 28 days before the date you ENTERED the UK, i.e. within 28 days before 17th January 2016.

Mine is coming to 98 days and its awful as i cannot apply on the day of the visa stamp

Yes i came uk after more than 90 days... i have heard that either you come within 90 days or not , one can still apply ILR 28 days before date of entrance to UK... kindly confirm ?

I entered uk on 17th January 2011 so before 28 days of (17th January 2016) i can apply ???? So in my case i can apply on 21st December 2015???

If that is 28 days then yes. It can anytime in the 28 days before 17 January, doesn't have to be the first day.
