Dear all,
Please help me if anybody got ILR with similar to my case.
Tier 1 General. Applying under 5 year eligibility.
Got Red Light offence, captured by camera and received a letter.
I accepted the offence
Offence details
TS10: Failing to comply with traffic light. 3 points , paid £100 online.
Offence date: 13 Aug 2014
ILR appointment is on 10-Dec-2015
Question 1: Do I need to mention this under 7.1 in SET O ?
Question 2: Will I get ILR with this offence?
Please help me

You don't need to mention it if it was only FPN (from Police) & not from the court. ie you did not attend court etc

Hi Bruteforce,
Thanks a lot for your reply.
It is FPN only because I never been to court. I accepted and paid online
but on the DVLA record it was like
Court / Fixed penalty office: North London Magistrates' Court
That is why I got confused.
My confusion is why there is court name when I never attended to court?
Thanks
Vedeka

You need to double check where the FPN came from, whether it was from court which is unlikely or some police force.

Zhou received a fine and points. It's in your DVLA file too so you need to declare it. If its just one, you should be fine getting ILR.
Also if you don't declare and they find it later, they may refuse based on deception.
Do declare it!
eventually when you go for citizenship you will also need to declare it too!

If u never been court ...then just chill and apply for ill and no need to declare .....I got ilr with T'S 10 red light code and never declared as it's very clear on set o form
...and points on licence it's always appear as conviction court code etc don't worry that's just normal.

Thank you so much all for your quick reply.
Most of your advice is to declare it. Hence i will declare it.
@ ALI97
When did you got your ILR? Recently? or long back.
Thanks
Vedeka.

I was reading the ILRguidance notes and it says you don't need to declare FPN but I can't see why you would not need to for ILR but need to for British citizenship?
does this good character thing only apply to BC applications, does anyone know?
To be on the safe side declare it. it shouldn't have any bearing on you, especially if it's just one. we all make mistakes.

It also applies to ILR applications.

Hi Vedeka
I got ilr on November 14 and not declare FPN and even I not declare during tier 1 extension time in 2013
. now applying for citizenship will declare as per an form booklet instruction .
even you declare it it will not make any difference as FPN is not crimical conviction.
if FPN consider as criminal conviction then you would have to wit for 24 month before ilr application, but here nobody is saying to you to wait for 24 month before ilr application ,mostly member advise is to declare FPN so it upto you,
I just shared my experience as your post was suggestion anybody got ilr with ts10

Others have cited here that if you have not appeared in court then there is no need to declare it.
This is probably incorrect.
It is possible for a traffic offence to come to you by mail and you accept the judgement by mail.
In which case the court will pass a decision without you being present since the evidence is present in situ.
You always need 100% confirmation on the type of offense and the authority that issued it to determine if it was an FPN or a court sentence. A Subject Access Request to the Police will reveal this.

Dear All,
Thank you so much for each and everyone who helped me on my stupid questions.
It was really useful to read and understand everyone's experience to file application.
I GOT my ILR SUCCESSFULLY.
Lets come to the Issue now
Questions 7.2
I have selected NO
and I have not mentioned anything on the ILR application about my TS10 red light / Traffic light offence.
But I have just mentioned on the cover letter, in 3 lines about the incident like, date of offence, offence code, £100 fine paid online, that's all.
My personal thought: There is no conclusion about this topic. It is upto you whether you want to mention it or not. There is no clear document to say you have to or you no need to. This is just for our satisfaction.
Hope that helps for others.
Thank you all
Vedeka

Hi Vedeka
I got TS10 for signal jumping , 3 points and fine but from court. I have paid fine online and never visited the court.
Do I need to disclose this in application and will it be an issue for ILR? Did you go to Croydon for same day service?
Regards
Prasad
