EEA retained rights until 2021 ..completing 10 yr this year..


I came on a student visa in sept 2006
Got psw until 2012..

Got EEA family permit in 2012.
Divorce 2015
Got retained rights Jan 2016. Until 2021..

I am completing 10 years in UK this year..

Can I apply for long residency.. 10 year rule

Hi mate

Yes you can as long as you can demonstrate your right to stay during these 10 years and one or mixed of immigration categories will be calculated for 10 years (long route )

Only if you are able to demonstrate that you EEA national family member was exercising treaty right through out the currency of your marriage, and you have been working since your divorce, will you be able to add the period under the regulations towards Long residence.

Hi askaamir

In my opinion,PR can be acquired using a combination of time spent as a family member and time spent when rights have been retained, to break it down... considering you've got confirmation of retained rights you can apply for PR on completion of the 5 years i.e. the ROR + evidence of your own work activity since you retained your rights(this is a must) = 5years. you don't have to switch to immigration rules and pay so much more under different rules to get effectively the same thing. i.e. PR (EEA rules) and ILR (Immigration rules). hope this makes sense

I am married after retained rights..

I have been told that I can't bring my non EU partner

Unless n until I have PR..

My 10 years are completing In sept/Oct 2016

And EU visa incl retained rights makes me eligible for
PR in. Dec 2017...can't wait

I have a question.
Please help me

I came in UK in 2006 as a student.
While extending visa in june 2009( visa was expiring in July 2009) home office refused my application after 6 months . I received documents on 5 the December and 2009 applied again on 10 DEC and visa granted in feb 2010.
Since feb 2010 I have legal status and EEA visa expiring 2021.

Does that 1 refusal effect long term residence..

Please help me regarding this

It depends on the basis of the refusal.

If she was not exercising treaty rights, then this may be a problem.
