Tier 2 ILR questions

Hello There...

I need Help/Advice in regards to my ILR application (qualifying period of duration). I want to know if I will be able to apply for ILR on my visa expiry of Tire 2 (General) - RESTRICTED WORK. Kindly find below details:-

Place and Date of Issue
UK 15-04-2012
Valid Until
15-01-2015

Place and Date of Issue
06-02-2015
Valid Until
29-01-2017

Please let me know if UKBA will consider my applicaction on 17-01-2017 (planned application date for SAME DAY SERVIE) or advice when shall I apply for ILR so that my continuous residency in the UK (5 Year) is completed.

What was your visa status before Tier 2 General?

Hello.. Thanks for looking into my questions

I was on PSW visa vaild from 07/02/2010 to 07/02/2012.
Initially I came to UK on student visa.

Kindly let me know if you require any further information to look into this.

Assuming you are planning to apply for ILR based on Tier 2 General, you can apply no sooner that 28 days before 15th April 2017.

Applying in January will likely result in a refusal as you won't meet the residence requirement.

Why do you think you can apply 3.5 months earlier than meeting the 5 year requirement?

Kindly guide me on what to do after 29/01/2017 as my current visa expires on that date... How to fill the 3.5 month gap.?? Under which visa???/ so that I will be eligible under 5 year rule.

Get a CoS from your employer and xxtend your Tier 2 leave,
or
switch to any other immigration category you may qualify for!

Hello,

Kinldy assist me as need urgent help.

Tier 2 Start Date: 15-04-2012
Tier 2 End Date: 28-01-2017

Planned Application for Tier 2 Extension before 28-01-17, if I don’t get the decision until 20-03-2017 [The qualifying period for ILR {14-04-2017 less 28 Days} ]
Can I vary my leave to ILR SET(O) on the same day Premium service on 20-03-2017.
Will my Tier 2 Extension application period of 51 Days counted towards the continue period of stay for 5 year required for ILR.

Hi,

Yes. Your Tier 2 (General) extension would be counted towards your ILR requirement of 5 years. Please make an in-time application.

Tier 2 extensions, I believe are quite fast. I got mine in under 3 weeks in Jan 2015. (I applied online and sent the documents through post).

thanks for your reply, so just to confirm if I don't get my Tier 2 Extension decision by say 20-03-2017, I can vary my leave to SAME DAY(Visa premium service) ILR.

so in my case its better if my application is delayed i guess :D

Hi,

Sorry for the misunderstanding. My view was to apply for the T2 extension. Once you get your extension visa granted, wait until you complete the qualifying period and then apply for ILR. This, of course is the more expensive but safer option.

I am sorry to say I have no idea about varying an application. Someone with more expertise would be of help.
