Tier 1 general ILR application after tax ammendment

Hello, i have been reading this forum, its been really helpful but most of people come to this forum if they have issue with application. I would request to people to come forward and discuss how they resolved the issue and get ILR successfully. I have applied to ILR last week and I am bit worried for it as there was 2010-2011 tax amendment and I heard that HMRC don't not Update SA302 but only gives you account assessment document to pay the difference. Now my concern is weather to send tax amendment document for 2010-2011 to home office or not (I can still send additional document before biometric) . Not sure if its going to work in my favor or against me ?
If any one applied for ILR after amendment , please share your experience.

Hi Richtich,

I am in same situation, I applied my ILR on 23April(19th April I have sent my amendments to HMRC and HMRC updated their records on 20th May), and I have submitted my Bio-metrics on 20th May.

I have contacted two/three solicitors whether to sent additional documents(amendment doc's) to UKVI or not, one suggested may be it is good to inform them before they find out even there is no guarantee that UKVI accept on the positive side and others suggested no to(in case if you a lucky escape).

So I have decided my self not to sent any documents and waiting for the results, it is now almost 11 weeks.
It is purely depend on your choice both have same/slimier consequences.

Hi devi2211, thanks for sharing your case. I discussed with few solicitors and they advised the same. One said he applied to 4 clients with same situation and 2 of them get accepted and got ILR successfully and 2 got refused. I don't know much details about them though.

Could you please update me if you get your decision or any of your friends in similar situation. I will keep updating you as well.

Hi Devi 2211,

When you say HMRC amended their records, does this mean they sent you a SA302? I have heard that they not updating it but only sending amended assessment letter.

Hi Nasir,

Yes, HMRC is not updating SA302 just sending amendment letter.
Actually I have made two years amendments 2012-2013 and 2013-2014, for 2012-2013 HMRC sent me a separate letter(not updated SA302) but for 2013-2014 HMRC updated my SA302.
HMRC said they can only update SA302 from 2013-2014 on wards, they can't go back before 2013.

I saw your post in other thread for upgrading to premium service, even I thought to upgrade, but as my case is not straight forward and if I upgrade and if UKVI says your application is not eligible for upgrade(UKVI saying this in case any application needed further checks or if the application is already decided), I will be in panic until get the decision letter.
I know, it may not change the decision if we upgrade or not and I don't have any urgent travel so just finger crossed and waiting.

I am still waiting, exactly finished 3 months and it seems to be taking long as I can see other people updates.
No, I haven't send any amended documents to UKVI.

Hi All,

Mine is similar case.
Amended the Tax returns for 2010-11 and 2012-13 years. HMRC came back with TAX I owe to them for these 2 years.
They confirmed, they cannot update the SA302, but they will summary of taxes for above years.

My ILR application was send end of May 2016, biometric done during mid-June.

Hi,

My friend cousin got ILR after Amendments.
They have applied through post end of Jan and submitted Bio-metrics in Feb and received the ILR approval letter dated 25th July.
They have sent amendments for 2010-2011(don't know, how much difference) to HMRC just before applying, and HMRC processed in June and they haven't sent any amended doc's to UKVI.
They have received ILR exactly the last week of 6 months.

Hope we will hear good news soon.

Hi @devi2211, thanks for sharing this. do you know if SA302 was updated too after they amended tax because HMRC does not update SA302 anymore, only provides amendment statement ?

I amended tax return for 2013-14, genuine mistake, but sa302 is not updated, asked HMRC 2-3 times but they said they can't update sa302 any more as it's out of time now, they said they can update sa302 only for last year return.

Hi jan39,

Not sure how HMRC is dealing, but they have updated my SA302 for 2013-2014(actually for 2013-2014 I have reduced the dividend amount which I declared first time),
for 2012-2013 they have sent me a tax statement(separate letter).

@richtich, even in my friend cousin case, HMRC not updated SA302. anyway they haven't sent any amended documents to UKVI.

Now they not updating sa302, they do only for last year.
You said they haven't sent to UKVI, how do you know it?
Do you think UKVI will still get the old figures in case they wish to verify the previous years earnings with HMRC?
As I can see my tax overview in my online HMRC account shows the amended figures but the sa302 is still showing old figures, and tax overview can be submitted to UKVI instead of sa302.

Hi All,

I have been advised that, as SA302 is not updated for above tax years, to send the document received from HMRC to HO as additional supporting document for self employed earnings by POST to support my ILR Application.

In case HO needed to check the SA302 records, they can find from this amendments documents issued by HMRC.

My questions:
1. Will I be risking by identify the amendments were made, which may go against my application result?[/size] OR
2. Will I take a risk, of getting rejected, in case HO find out the HMRC records don't match with earnings declared to HO during the initial and extension Tier 1 Gen application?
3. keep quiet and wait for decision and resolve matter after the decisions?

option 1, 2 or 3 would be good in my case?
Does anyone have went for option 3, and got successful result?

Hi Naseer,

As I explained in my previous post(please check above post my Friend cousin, they haven't sent any additional amendment documents to UKVI). they thought about it sending the letters received from HMRC after amendments(even their SA302 is not updated), but it was too late for them to send it because they applied end of Jan and amendments processed end of June almost 5 months after sending application so they decided not to send any documents in case their application is already decided/about to decide..
so they just waited for the decision luckily they got approval.

0-100% ? How will you calculate/apply this answer on 20 applications where some are successful and some are not?
Although the question is complex, and not easy to answer on this forum as not all applicants are same or they may not use this forum yet we can have some data through the success rate on this forum at least.

Success rate can be found out from the number of applications submitted and the number of applications refused/accepted or successful/unsuccessful.
There should be a separate thread like:
Applicants with amendment should answer:
Successful = Yes/No
And from the answers we can say 20% or 50% etc.

% of success is completely irrelevant and will not help anyone one in anyway, and must be the success depend of the specific case only. I do not know how the % can help anyone :( got surprised that is why mentioned between 0-100% :idea: and definitely the answer between this!

For the sake of only data or statistics we can get the % answer. For example 10 out of 20 applications with amendment are successful can give the 50% success rate regardless of the case nature, it can give a rough idea that 50% cases with amendments are going in success.
I already said it's complex as every case is different but for the sake of calculating success rate only we can get the answer in % if all applicants on this forum share the outcome of their cases without going in detail.
But saying 0-100% to me is unclear.
Of course every case is not same and a successful case on this forum doesn't guarantee success for other applicant but still people are using this forum to get some sort of idea or data.
I will give an example of a friend who doesn't want to apply for ILR at all because he thinks it will be a refusal straight away as he had done one amendment but the success ratio can change his mind.
