Applying 39 days early for SET LR.

Hi, My tier 1 visa expires on 10-October-2016, and my 10 years completes on 17-November-2016. Can I apply 39 days early (by post) for my Set LR and then upgrade to PEO once I do my biometrics?

The guidence says that you should not apply earlier than 28 days before you complete 10 years. It also suggests that date of consideration is important in determining wether an applicant has completed qualifying period. The guidence also mentions that "you should not apply any earlier than 28 days" is not a mendatory requirement. A number of cases in this forum confirms this that the people applied early got their visas.
However, at the end it is your decision to apply direct using SET (LR) or if you want to vary to SET (LR).
Postal application can be upgraded to PEO. However, it needs to be approved by the UKVI once applied and not gaurenteed. Hope it helps

I think you should apply for Flr (FP) 1st then vary it to Set (LR) at PEO 28 days before completing the 10 years. That will be safe and quick way to get ILR.
