ilr application when can be made

Hi,
My husband has Tier 2 general visa . his visa was issued in 20 November 2011. He is planning to apply for ILR. If his eligible date to apply for ilr is 28 days before 20 November 2016. Is that mean he cant apply after the qualifying period, which is in his case after 20 November 2016? why I got the doubt is in premium service appointment booking it says the settlement application should be made within 28 days of the qualifying period.
Can someone reply me whether he can apply anytime after the qualifying period? And at that time can he use premium service for applying for ILR ? Because he is planning to apply by end of dec or early jan.

You've misunderstood. Your husband can apply any time within the 28 day period before the expiry date of his visa.
An application within the same time scale can be submitted in person at a PSC for the premium fee.

And he can apply anytime AFTER reaching 5 years residence too, as long as he applies before his visa expire.

ok. thanks. But can he apply via premium service centre? Why i am asking again is in premium centre appointment booking page it says the appointment should be within 28 days of the qualifying period for the settlement application. that is confusing me.

Yes, he can. He can book an appointment anytime once he has 4 years, 11 months and 2 or 3 days residence.

Residence you mean from the date of entry ? Actually he was issued visa in nov 20 2011 and he entered uk in jan 22 2012 . with this info, can you tell me when the residence starts ?

As he entered the UK within 90 days of visa issue date, he can count his residence from 20 November 2011.
