Is ICT Skills transfer considered for ILR

Hi Experts,

Excerpt from the UKBA site states the following regarding ILR for Tier 2 ICT. The first sections states ICT should have been issued before 2010 and the second section does not state any rule that it should be issued before 2010.

also, i have come on ICT Skills Transfer in 2010 July and from 2011 i am on ICT Established staff/long term staff. Can i combine both the visa categories while filing for ILR. I am aware some of my friends have got the ILR if the permit was issued after april but within 2010.

Any advise on this is much appreciated..

To qualify, you must have had at least one of these visas in the 5 years:

Tier 2 (Intra-Company Transfer) issued under the Immigration Rules in place before 6 April 2010
Work Permit for an intra-company transfer

You can have had any combination of these visas during the 5 years:

Tier 2 (Intra-Company Transfer)
Work Permit in the business and commercial category or the sports and entertainment category
Representative of an Overseas Business

Tier 2 ICT applied for and issued ON or AFTER 6th April 2010 DOES NOT lead to ILR. So the answer is no, you cannot apply for ILR.

The crucial date for Tier 2 ICT is the date of application (the date the application was received by the Home Office), not date of issue of the visa. If the date of application is before 6th April 2010, it could possibly (depends on subsequent visas) lead to ILR. If the date of application is 6th April or later, you're out of luck, except under the ILR (LR) 10 year route.

Do an SAR on the Home Office to find out the date of your initial T2 ICT application.
