Dear All ,

My application was refused due to in HMRC Dividend income not recorded in Aug 2016
AR refused again
I was served Enforcement notice with no work right and Driving license revoked.
got Over stayed I believe.
Applied for JR in Oct
Home office has withdrawn In JR in Jan and said will provide new decision.

My Question is what is my status now and Work right and License?

and when HO withdraw original decision what are the chances .

If your previous visa has expired, you now have now work rights and your driving license will be revoked if you have no leave to remain. Your rights will only be reinstated if you are successful with JR and get ILR.

But JR is finished as HO has taken the refusal decision back during process of JR and said ll give new decision .

If you made an intime application for ILR and home office has agreed to reconsider their refusal decision, you are technically protected under your 3C leave as it would imply that you have never been refused before so 3c should continue.

You should negotiate consent order with home office on below terms:

"upon the respondent agreeing to withdraw the original refusal decision and upon the respondent agreeing to reconsider the decision"

If home office agree to this consent order which they should, you will then be able to reinstate your 3c until reconsideration decision is made. Have a look at page 8 below

Yeah got letter from HO I am covered with 3c and dvla licence ll be reinstated again .
