ILR Eligibility for Tier 2 General Dependant

Hello,

I am currently on a Tier 2 General visa. My visa was issued on 01/02/2016 and I first entered the UK on 28/02/2016.

My wife applied as a dependant, and her visa was issued on 06/04/2016 and she first entered the UK on 08/04/2016. Therefore, she entered roughly six weeks after me.

My question now is: when I am eventually eligible to apply for my ILR in February 2021, will my wife be eligible to apply with me, or would she technically not qualify given that she is 6 weeks short of completing 5 years?

How would something like this be handled?

No one knows what the rules will be in 2021.
Ilr rules that will apply to you will be the ones which are the rules on that date.
As per current rules, she will not be eligible. She has to complete 5 years to the date of her arrival. which makes it over 9 weeks, not 6 weeks.
she will be eligible to apply for extension , if and when u get ilr.
