Her residence is based and counted from the date she ENTERED the UK, so no sooner than 28 days before 12 September 2017. The 90 concession is only for PBS main applicants.

She is also subject to the recent change for PBS Dependents where the absence limit is 180 days per 12 month period.

On what date in 2012 did she APPLY for her visa?

Thanks a lot for your feedback

She applied her visa on 13/07/2012

Is that definitely not counted ?

Thats a shame that she didn't apply 5 days earlier as then she would have been on the 2 year route.

Nope, not counted. It is the date she entered the UK that is counted as the start of the 5 year residence period.

Kindly refrain from tagging your questions onto other members topics when you have your own topic already.

You don't need a solicitor. Read the Set(O) form and guidance notes.

Hi, sorry to disturb you here. Has the count way for PBS dependant's ILR qualifying period been changed? Because I have read a few of your replies in other posts which are saying the start of the qualifying period is from the visa valid date. I'm getting confused from this post now. I would be appreciated if you could give me a little help.

Useful to start your own topic or continue in a topic you already have rather than tag onto one from mid 2017 as the above is no longer relevant.

The rules changed on 11th January 2018!!
