Hi All,

I am very confuse on how to go about my ILR in June, 2016... would be helpful if any senior member advice me on what to do next.

Visa granted status
14-06-2011 Tier 1 Granted
14-06-2013 expired tier 1
03-07-2013 Tier 2 granted
28-06-2016 expires tier 2
24-10-2016 Tier 2 extension granted
28-12-2018 expires Tier 2 extension

5 years calculation
22-02-2017 TO 23-02-2016 - 1 - Tier 2 - no leaves - Compnay A
22-02-2016 TO 23-02-2015 - 2 - Tier 2 - 16 Days leaves - Compnay A
22-02-2015 TO 23-02-2014 - 3 - Tier 2 - no leaves - Compnay A
22-02-2014 TO 23-02-2013 - 4 - Tier 1 + Tier 2 - 29 Days leaves - Compnay A
22-02-2013 TO 23-02-2012 - 5 - Tier 1 - 6 Days leaves - Jan - 2012 to Jun 2012 (no job) - Jun 2012 - Started working for Compnay A

now,
1) as i can see i am eligible to apply for ILR on the basis of above 5 year period. Am i right on this one?
2) as i will be applying ILR on Tier 2 basis, Do i still need to be in work for the same compnay?
3) as i understand, I need to get a letter from company stating that my services are still required. I will not be able to get this, can i still apply?
4) as i was not working before starting job in Compnay A, do i still need to worry about all Tax, HMRC doucments for my Tier 2 visa?
except for 5 months, my entire 5 year period i was working in Company A

Please advice on my situation. Appreciate your time and help.

No, it is a mandatory requirement for Tier 2 General applicants.

so the only option for me is to find a new sponsor within 60 days and then apply for ILR.. is that correct?

what happens if i dont get a new sponsor within 60 days and lets say i got new sponsor and made application for new Tier 2 on 95th day, does my continues period for 5 years break in this case? even though i do not receive any letter from home office curtailing my visa...

Some have got ILR others have been refused due to the gap of 60 days more between employment.
