ILR Dependent Confusion - Please help

Post by sajan.chandran » Tue Jan 31, 2017 5:29 pm

Dear Friends,

Can some one please clarify whether my wife can apply for ILR or not.
My Status:
Was Initially on Tier 1 General Visa - Got ILR on July 2015 (5 year route).

My Wife:
Tier 1 General (April 2009- April 2012) - Came to UK around March 2010 - Tier 1 Extension got rejected because of Incorrect fee paid.
Went to India - Applied as a Dependent
Tier 1 Dependent (05/07/2012 - 10/04/2014)
Went to India - Again applied as a Dependent
Tier 1 Dependent (16/04/2014 - 10/04/2017)

Is my wife eligible for ILR ?
Can some one please clarify.

Many thanks.

It seems that she may be eligible for ILR, as long as her continuous leave was also maintained, etc.

Thanks, yes she hasnt been outside UK for more than 180 days.
But am just worried about this

Tier 1 Dependent (05/07/2012 - 10/04/2014)
Went to India - Again applied as a Dependent
Tier 1 Dependent (16/04/2014 - 10/04/2017)

Since she applied from India, she doesnt have BRP card issued, also she has a few days (6 days) between her extensions. Please see the dates above.

Thanks in advance,

I think that she's okay, if she applied for entry clearance within 28 days of expiry of leave.

If you are on ILR via T1G and now only applying for T1G-d to ILR then not sure why you are thinking about this :!: there is no previous earning assessment/requirement when dependent alone applying for ILR.

So there is no need earning assessment/requirement for dependent ILR ?
So only cohabitation documents, marriage certificate and life in uk test sufficient ?

Thanks,

Thank you @CR001 very much.
While filling the SET(O) form, the section 5 asks about Home and Finances, since my wife is applying on her own,
Do we need to provide any supporting documents i need to provide for section 5 (like any salary slips etc) ?
Also can u please explain the number of years of cohabitation documents i need to submit.

Thanks,
Sajan Chandran

UK Naric Letter - ILR Dependent Application - Urgent help

Post by sajan.chandran » Thu Feb 23, 2017 11:40 am

Dear Friends,

My wife applied for ILR (she is currently T1G - Dependent) at Solihull PEO office, they asked us to submit a UK Naric letter within 14 days confirming her qualification and her english language assessment.
But when i check with UK Naric office they said, that they will take atleast 10 working days for processing (Visa and nationality Service).
WIll we have enough time to get the letter from UK naric and send it to Solihull PEO office.
Can someone please help, what should be our next steps.

Thank you in advance.

Thanks,
She has submitted her original bachelor degree certificate, since she already proved her english qualification as part of her previous T1G application we didnt get a letter from UK Naric.
But now they ask us to submit the letter, even though my wife explained them the situation they are not ready to agree and ask us to submit the letter.

She needs UK NARIC ELA - the UKVI red route - for ILR. HO don't want an 'explanation', they want to see the proof from NARIC if she is using a foreign degree. Page 15 of this form clearly states what is required so not sure how you missed this point.

She could also have done a B1 English test, which is the same price as NARIC and it is quicker.
