Hello everyone , this forum and the memebers have been really helpful for many as like me. Now I am coming to you guys to have your honest advice on my situation. Please see below my residency statua d the years
OCT 2007 - arrived as a student
NOV 2009- extended as a tired 4 student
Swtiched my visa on April 2011 as a PBS dependent and was granted on Nov 2011
Student Visa and PBS dependent visa curtailed on SEP 2014 and applied for EEA EFM in AUG 2014.
Eea EFM refusal- Dec 2014
First tier Tribunal dismissed- Aug 2015
Application for persmision UTto FTT refused- Jan 2016
Permission to UTT TO UTT refused -Feb 2016
Fresh Application EEA EFM made with 28 days of UT in March 2016
April 2016-HO took the payment for my wife who was a dependent on my application and didn't take the payment for myself the main applicant and returned buth application forms due to the non payment how ever , it was very clear that HO made an error when processing my bank card and took only one payment.
April 2016 - resubmitted application again with postal orders and pointed out to HO in a covering letter with the copy of bank statement that HO made the error while processing the payment.
24th Oct- varried my application to FRL O, however HO taken a dicision on my EEA EFM on 25th OCT refused and metioned SALA and no appeal rights .

Feb 2017- solicitor advised me to vary it to FLR fp to buy more time. vardied my application and still waiting for the Biometrics.
What my solicitor is saying that after buying more time on FLR fp we can vary this to Set LR , however he told me it wouldn't be a straight forward application and I may have to fight through appeal to get my ILR . can anyone please give me your honest opinion and advice on my case please. I really want to know as I am preparing myself for the set LR application.

Who is the relative you based your EEA EFM application on?

EEA EFM applications DO NOT extend section 3C cover. You have therefore had no valid leave since 2014 when your student visa was curtailed which means you have a break in continuous residence and won't qualify for Set(LR).

Hi Casa, thank you so much for your reply . My EEA EFM based on cousin. My Aunt's son. It was a genuine application and we submitted all the orginal money transfers proofs since 1992. I was unlucky that why I lost my appeal at Ftt and judge was onesided and she just dissmed for not satisfied as she couldn't see how did I spend the money he gave when I was back . Anyways Thats why I made a fresh application again with all th relevant information and proofs but still the HO refused with out an appeal rights as because of recent SALA case outcome.

Can you please tell me what can I do now as you mentioned that my sec 3c doesn't cover . Is there any other way I couuld fight through appeal , should I get a refusal.

Which application are you referring to that you want to fight?? Not all applications have appeal rights within the UK.

You won't qualify for long residence ILR as you are an overstayer.

By submitting FLR(O) and FLR(FP), what reasoning did you state in the application that you believe qualifies you for these applications?

You should be aware that HO is very aware and on top of these 'buying time' applications and consider them 'frivolous' applications.

On what basis have you submitted these two applications? What reasons have you provided to qualify?

Hi CR001 sorry for the late reply. My solicitor made those applications to buy more time to make SET LR . Will I be given sn appeal for my SET LR application?? Please also let me know any suggestions. Thank you

Hello mate.Can u let me know,which documents you submit with FLR FP application.I will submitting this application in next 2 weeks to gain 1 month for eligible for ILR 10 years long residency.

Hi Muhammed ,, it was prepared by my solicitor.. also we submitted documents such as educational qualifications, character letters .. charity works ect....
