Hello everyone,

I will appreciate if someone can give me advise.

In jun 2018 I will be lawfully in UK for 10 year. My current visa was granted in march 2014 for 5 years as a family member of a european. My boyfriend and I apply for unmarried partner visa after being living together for more than 2years. Now we are in the process of separation and I would like to know if I can still apply in 2018 for long tern residency on my own rights or if I have to go back to my country.

I have a good job in UK and I have being paying taxes during all my time in UK.

Thanks,

Maria

As an unmarried partner of an EU national (assuming you have a EEA EFM Residence Card), once you separate you have no rights to reside in the UK. If you separate and you have no rights, you cannot apply for ILR as you are required to produced evidence of the EU partner exercising treaty as a qualified person for the whole period that you are on an EEA residence card.
