Dear Forum members,
I am asking it for my friend.
He is applying for his wife's dependent visa as a Tier1 Entrepreneur. He got extension in October 2016 and got married in end February 2017.
1): Does his wife need to fulfil english language requirement.
2): His business is in loss, will it affect his wife's visa decision?
3): When he will apply for ILR, If his business will still be in loss, how will his wife become dependent on FLR(M)? Will he be required to show minimum salary of £23500 or turn over of £23500 to support her application?
4) If his wife gets a job and provides her income as a proof, can she become FLR(M) dependent?
Thanks a lot.
cheers

1): Does his wife need to fulfil english language requirement.
PBS dependant visa has no English requirement
2): His business is in loss, will it affect his wife's visa decision?
This has no relevance to PBS dependant visa
3): When he will apply for ILR, If his business will still be in loss, how will his wife become dependent on FLR(M)? Will he be required to show minimum salary of £23500 or turn over of £23500 to support her application?

1) She needs to prove her knowledge of English by passing an approved English language test with at least a CEFR level A1 in speaking and listening
.
2) For finances, the money can come from her employment, her husband's or any savings the held for at least 6 months.

Hello Zimbaa,
I'm on tier 1 entrepreneur 50k and extended my visa last month with 3 dependants. They came UK in 2015 and will not b eligible for IRL with me as i will apply for ILR in 2019. From your above reply my understanding is that at the time of My ILR application there will be minimum earning requirements to extend their visa.
If I'm right then how much or if I'm wrong then what will be the process for them.
Thanks

On what basis is your 'friend' applying for ILR - 5 years Tier 1 or 10 years long residence?

Dependents can continue as PBS dependent visas until they meets the requirements for ILR. There is no mandatory requirement to switch to FLR(M), which resets their ILR clock to zero.
