ILR Dependent qualifying period- Multiple visa

Hi,

I'd first come to UK on Tier 2 Intra -company visa in July-2009 and then year later (Aug -2010), my wife joined me here on dependent visa.

After spending 5 years (my wife 4 years), we moved to Jersey - Channel Island for the same company. My Tier 2 intra company visa converted to jersey work permit (which is equivalent to tier 2 in Jersey).

Later I obtained ILR in Jersey while my wife was on dependent visa.

Then I moved back to UK in 2016, and got my BC while my wife is still on Jersey dependent visa.

My wife had spent last 6 years and 7 months with me on dependent visa ( 4 years as tier 2 dependent and 2 years on Jersey work permit dependent).

Can my wife apply for ILR based on 5 year qualifying period? does qualifying period has anything to do with category of visa.

Any suggestion will be greatly appreciated!..

I tried looking for answer to my queries but didn't find any suitable answer for my queries.

I'm looking for calculating 5 years for my wife.

My wife has joined me Aug-2010 on Tier 2 dependent visa and after spending 4 years, we moved to Jersey - Channel Island. (Jersey is part of UK) for the same employer.In Jersey, she had applied for dependent of my Jersey visa.

I've completed my my 5 years in Jersey and obtain ILR in Jersey and later return to UK and got my BC.

Now, I'm planning to apply ILR for my wife but query had arisen regarding her 5 year qualifying period.
She had spent last 6 year as my dependent ( 4 year in Tier 2 dependent + 2 Jersey dependent).

I think only requirement is for qualifying period is, 5 year dependent visa in any visa category? Is that my assumption correct. Any link or document to confirm the same.


Any pointer would be greatly appreciated!.

It seems the answer is YES. The calculating continuous period in UK guide says:
Time spent in a Crown dependency in a qualifying category counts towards the continuous residence period.
Read that guide for more information and the conditions.

I'm already BC and my wife first entered in the UK in Aug-2010 through dependent visa.

I'm not sure how much qualifying period is required for her to apply for ILR.

Does BC spouse have any qualifying condition attached to them?
