TIER 2 to ILR - employer absence letter

Hi folks,

Can anyone share a template/wordings on what is exactly required from the employer when I have been away for business trips.

I have not been out of the country for 180 in any continuous one year period, however I have made several business trips abroad during the last 5 years. Does the employer simply need to state "approved business trips" as the reason or does the employer need to provide additional information for each business trip and justifying its purpose?

There is no 'template' letter and you should never use a 'one size fits all' template for things when dealing with HO. Your employer simply needs to list/state your absences etc.

Don't forget you also need a letter stating '...you are required in your position/job role for the foreseeable future'.

ILR rejection - what happens to TIER 2

Hi folks,

I was granted my Tier 2 General visa on 24 May 2012 for 3 years after which it was extended for another 3 years in May 2015. So my current Tier 2 visa expires on 24 May 2018.

Since I will be completing 5 years on my Tier 2 visa on 24 May 2017, I am looking to apply in person for my ILR application on 19 May 2017.

I wanted to know what would happen if god forbid my ILR application got rejected for some reason, does it mean that my Tier 2 general visa is cut short and invalid too or can I still stay on my Tier 2 general visa till May 2018?

Your tier 2 will have no effect.

As long as there was no deception or other violation used to acquire the Tier 2 visa, which they will look into, then an ILR refusal will have no effect. If they uncover that the Tier 2 visa (or the extension) would not have been granted as a result of information they find out while processing your ILR, they yes they might go after that as well.

Assuming you meet the salary requirement and there has been no sudden large increase just before you apply for ILR, you should be fine.

If ILR is refused, one problem/frustration will be extra waiting on UK borders, e.g. airports. UKBA staff will temporarily detain you until he/she carries out further checks as system asks to do so. You will be asked to wait in waiting area and depending on speed of UKBA officer, you will need to wait 20-30 minutes extra before he/she verifies that your visa is still valid.

Thanks all for your responses. I am still paid above the minimum threshold for my job role and have never been in violation of any rule. Thanks again for the comforting response :)

As we don't know what the 'minimum threshold for your job' is, is it at least £35,000 pa??

Yes my salary is above the minimum requirements for my job code and above 35k

which documents required to apply ILR for tier 2 visa? What are documents you requested from your employer.

What are the documents required before going to interview?
Please list all the documents you submitted at interview.
