Tier1 Entrepreneur Dependent ILR Query

Hi to All,

First of all i would like to say thanks to all. This forum is very helpful and and sharing a very good amount of knowledge.

I have a query regarding the Tier 1 Entrepreneur dependent ILR (When to Apply)

Main Applicant
I came in UK on 07 September 2008 as a Student Expiring September 2009
Got Student Extension till January 2011

Got PSW from 2011 to 2013

Got Tier 1 Entrepreneur on 28 October 2013 Expiring 28 October 2016

Got Tier 1 Entrepreneur Extension with 3 x dependents on 23 January 2017 will expire on 23 January 2019

There is no 180 days absent all the above periods

Dependent Details:

3 X dependents got Tier 1 Entrepreneur Dependent Visa on 17 December 2013

But they entered in UK on 17 May 2014 (After 5 Months of Entry Clearance)

1 X New baby born here in UK on 20 April 2017

Query :

My 10 years are completing on 07 September 2018 as a Long Residency

Tier 1 Entrepreneur 5 years are completing on 28 October 2018 but to apply for ILR on Tier 1 Entrepreneur basis i have to wait till December 2018 because to fulfill the employees conditions as you know that the period home office took to make extension decision could not count towards employment .

I can apply my ILR on 10 years basis but then my dependent clock will star again and they have to wait another 5 years to eligible for ILR

My main question is that the period my dependent got the visa is countable towards the 5 years or the period will start when they entered in UK . I want to apply ILR on Tier 1 Entrepreneur basis with my dependents.

They got Tier 1 Entrepreneur Dependent visa on 17 December 2013 and

They entered in UK on 17 May 2014

For dependents, it is counted from the date of ENTRY to the UK so they will only qualify in 2019 for ILR.
