ILR Eligibility Enquiry - Based on CoS

Guys

One of my friend thinking if he can apply for ILR (5 years category type) based on the below facts.
Can you someone suggest, is it worth a try?


Visa Type - Tier 2 ICT Established Staff (Now its - Tier 2 ICT Long term, after extending)
Date of COS issued - 30th March 2010 (COS - certificate of Sponsorship)
Application submitted to VFS - 15th Apr 2010
Date of Stamping - 10th May 2010
Date of Entry to UK - 11th May 2010

Based on the common fact as he had got Visa and travel date beyond Apr 6th 2010, he has assumed that he is not eligible for ILR under 5 years category.

However by checking his COS approval/issued date as 30th Mar 2010, now he is checking that if he will be eligible to apply with this COS fact via Solicitor.

Please suggest guys.

No, it is NOT based on the date of CoS issue.

On what date did your friend PAY his visa fee in 2010??

Thanks for the reply.
The fees had been paid after Apr 6th only. He said that would be around Apr15th.

Unfortunately your 'friend' has missed the relevant date by one day. He falls under the rules in place from 6th April 2010.
