ILR - English Language Requirement - Query

Post by piscean_sa » Fri May 12, 2017 8:10 pm

Hello,
I have a question about meeting English Language requirement for ILR and I hope you guys can help.
I am applying for ILR in the next few weeks and I would like to know whether I need a letter from NARIC confirming my degree.

I have a Bachelor's Degree in Arts from a non-English speaking country. It was taught in English.
I have a certificate from the university confirming the details as well as a separate letter confirming that the degree was taught in English.

These two documents were accepted by Home Office twice as evidence of my English Language requirement - one at the time of entry clearance for spouse visa in July 2012 and on at the time of extension of spouse visa in 2015.

Can I now apply for ILR (in person application) and satisfy English Language requirement on the basis of above mentioned documents and without the need of letter from NARIC?

Any help with this would be appreciated.

Thank you

SA

If they have been accepted by HO in previous applications, than should be no problem but still needs some more information just for safe side.

The guidance states that :

You can also meet the English language requirement, without the need to provide evidence, if
you were last given permission to stay in the UK:
 under Tier 1 (General), Tier 1 (Graduate Entrepreneur), Tier 1 (Post-Study Work) or Tier 1 (Entrepreneur) and are applying for an extension of leave to remain

For my ILR application, I did not add any additional evidence.

To be on the safe side, I added the following text in my cover letter.

1. Section 4 - Knowledge of language and life in the UK
We are claiming exemption from providing evidence, based on the Tier 1 Guidance which states:
“You can also meet the English language requirement, without the need to provide evidence, if you were last given permission to stay in the UK:
- under Tier 1 (General), Tier 1 (Graduate Entrepreneur), Tier 1 (Post-Study Work) or Tier 1 (Entrepreneur) and are applying for an extension of leave to remain;”
As someone with the last permission as a Tier 1 (Entrepreneur), I would like to claim the points for this without providing evidence.
The form does not offer a straightforward way to use this option. I have hence checked the box in Question 4.3 as having a degree equivalent of NARIC qualification (which I believe our qualifications are) without evidence attached.
