ILR FINANCIAL THRESHOLD WHILE ON MATERNITY LEAVE

Hi everyone it is my first on this forum. I need your expert advise
I'm a foreign wife married to a British citizen for nearly 4 years now. I am due to apply for my ILR (5 year route) on August 2018. My husband and I both work fulltime and able to meet the financial THRESHOLD requirement as we both combined our wages for all the applications we've had so far.. but i am now pregnant and expecting to give birth in March 2018 meaning I will be on maternity leave by the time I apply for my ILR in August 2018.
My question is will that affect my application as my husband won't be able to meet the £18,600 plus another £2,500 for 1 dependant without combining my wages too as I will be on maternity leave. We are both confused and worried that the baby will not allow me to apply due to financial constraints when that time comes. I need your advise. Thank you so much

This is not an issue. Stop worrying, you will be fine if husband meets the financial requirement alone.

Hi thank you for the advise. My husband will NOT meet the financial requirement alone as we've been combining our wages on all of our application. Me being on maternity leave when that time comes means less money to meet the requirement. This is what my query is all about. But thank you

What is your husbands earnings per annum alone?
When do you go on maternity leave?

That's fine I really appreciate your time responding to my query.. my husband's income is about £17,500 per annum and I go on maternity leave March 2018. I'm applying for my ILR August 2018. Thank you

This may help:
5. In respect of statutory or contractual maternity, paternity or adoption pay all of the following, and in respect of parental leave in the UK only the evidence at paragraph 5(c), must be provided:
(a) Personal bank statements corresponding to the same period(s) as the payslips at paragraph 5(b), showing that the salary has been paid into an account in the name of the person or in the name of the person and their partner jointly.
(b) Payslips covering:
(i) a period of 6 months prior to the date of application or to the commencement of the maternity, paternity or adoption leave, if the applicant has been employed by their current employer for at least 6 months (and where paragraph 13(b) does not apply); or
(ii) any period of salaried employment in the period of 12 months prior to the date of application or to the commencement of the maternity, paternity or adoption leave, if the applicant has been employed by their current employer for less than 6 months (or at least 6 months but the person does not rely on paragraph 13(a)).
(c) A letter from the employer confirming:
(i) the length of the person’s employment;
(ii) the gross annual salary and the period over which it has been paid at this level;
(iii) the entitlement to maternity, paternity, parental or adoption leave; and
(iv) the date of commencement and the end-date of the maternity, paternity, parental or adoption leave.

@CASA: thank you for your response. Please correct me if I'm wrong the way I understood it is if I provide all of those written on 5 (c) then there should Not be any problem with the application regardless if my partner do not meet the requirement alone as my documents from employer should support the application.

That's exactly my understanding. You should also submit your most recent 6 months payslips together with the corresponding pay slips.

No problem, that's what the forum's here for. The guidance is often confusing.
(i) a period of 6 months prior to the date of application
or to the commencement of the maternity, paternity or adoption leave, if the applicant has been employed by their current employer for at least 6 months
My understanding is that as you will already be on maternity leave when you submit the application, it should be the 6 months payslips prior to commencing maternity leave, with the bank statements corresponding to the same 6 month period.
Your husband will have to submit his most recent 6 months payslips prior to the date of the application, together with the corresponding 6 months of payslips. Your husband will also need a letter from his employer confirming the terms of his employment.

Hi I’m in similar situation so not sure what to do as usually we would meet the required financial requirements but as on mat leave I haven’t received enough and not does my hubbys annual income be enough to meet current requirements.
We have always combined incomes and so not sure what category to apply under?
