10 year application after AR

Hi everyone
I have a question to ask, if Admin Review for a Tier 1 application is declined and you get 14 days after that to make another app or leave country. Section 3c ends the day AR is rejected
So if someone completes 10 year time period(albeit with the 28 days flexibility) in those 14 days after AR rejection, would a 10 year long residence application be valid if made wihin those 14 days after AR rejection?

Hi Zimba, sorry for putting my question here, actually it is related to above.
So it means if AR is rejected, we can safely apply on 10 year basis, 42 days (28+14 days) before date of completion of 10 years?
If i am wrong, please correct it.
Regards

No. Section 3C ends with AR refusal and therefore breaks continuity if residence.

On the lines of AR, can I ask a question.
I'm waiting for AR(ILT 5 year route) result. If I complete my 10 years in between and like to apply for 10 years route, I would have to with draw AR. Then what happens to 3C? or work rights?

No. It means if AR is refused and you are 28 days from being eligible then you can apply.
This means you must be already eligible if you want to apply within those 14 days

When you apply for a new application on section 3C, your section 3C ends automatically. You get no living/work rights until your new application is decided.

Hi Zimba
I am sorry but the questions above have confused me now ! If a person has ten years completing on 15 Sep 2017, that means they can apply for LR ILR 28 days before which lets say is 17 Aug 2017, so if this same person has had Admin Review for Tier 1 Extension rejected on 13 Aug 2017, so despite 3C ending on 13 Aug they would still be able to apply for LR ILR on 17 Aug 2017 and so UKVI wouldnt say their 10 year isnt complete due to the AR rejection and ending of 3c?
Appreciate your help !

Pretty much. If your AR is refused your section 3C ends and 14 days grace period starts. If during such grace period, you are within the 28 days mark for long residence, you can make a valid application for SET(LR)
