Please bear with me if this may seem long. I am very worried as I have been living in this country since the past 9 years and I am due to apply for my ILR next year. A stupid mistake has put my future in jeopardy. I want to know how it will affect my ILR.

My wife received her license a day ago and we were still looking for insurance for her when she drove just to park the car and police stopped her. She had license but not insurance. The car was insured but not on her name. The police gave her a FPN 6 points on her license and also gave me FPN and 6 months. They then sent a letter stating they cant accept my FPN and the matter will be dealt in court. However they accepted my wife's fine.

I am now worried after reading mixed comments online if this sort of conviction will led to my ILR being refused. I want to know if anyone has been through a similar situation and what happened with their ILR? For now I know you cannot apply until your conviction is spent which will take another 3 years from the date of court decision.

Please help as I am really worried and cant even sleep because of this. One stupid mistake and my whole future seems blur.

First of all, why did they issue you FPN. And was what the reason for not accepting fine that they have taken to court?

If your FPN was accepted then you would n't have to worry. Since this has gone to court so you'll get court conviction. Normally Court conviction means you cannot apply for ILR for 2 years.

As per ILR rules you will get refused but it is upto officers discretion.He may let you go.

You wait for Gurus to respond but to me its looking tough for you now.

Allowing an uninsured driver to drive usually results in a fine of up to £5000 and 6 points or more, doubt you get away with an FPN.

Depends on the court ruling. The Immigration rules say your ILR should be refused if:

within the 24 months prior to the date on which the application is decided, been convicted of or admitted an offence for which they have received a non-custodial sentence or other out of court disposal that is recorded on their criminal record.

The court might simply enforce the FPN and penalty points. Unless you get a non-custodial sentence, your ILR may not be refused.
