Which route is best to ILR! Please Advise

Hello Experts,

1) I have been in the UK since March 2011 on Tier 2 ICT and my employer is happy on keep renewing it. My latest one will expire in 2020. I believe by 2021 i will have the 10 years of long term stay completed to apply in the that category.

2) My Mrs has been in the UK since 2010 on Tier 2 ICT and we got her ILR done last year before our boy was born. The boy has got the UK passport. A few people advised I could now apply through my Mrs ILR to get my ILR sorted. However, a friend of mine told me I will first need to shift on a dependent spouse visa and do five years on it. If that's the case, it will take my date to 2022.

3) Another advise was to have the Mrs process the citizenship this year and apply directly for the same. But, I guess the same condition of time resetting is valid for it as well.

I will appreciate if you could share some valuable advise.

There is no quicker way to get ILR or citizenship for you.

If you switch to spouse visa, you are free to work for any employer and it will still count towards 10 year ILR. Resetting is only relevant if applying for ILR based on 5 years residence.

Thank you for response. Would it be any different if my Mrs gets the citizenship? I mean can I just bypass the ILR completely.

No you cannot. In order to qualify for citizenship, you must hold ILR.

The only advantage if she has citizenship already when you apply for ILR is that you do not have to wait 12 months on ILR before you can apply. You would be able to apply for citizenship as soon as you are granted ILR.
