ILR Long residency under police investigation

Hi I have a questions about my ILR LONG RESIDENCY application. I am due to apply for my ILR at 7 Aug, but I was released from the police under "further investigation" last week. I was not charged and released without bail nor conditions. My solicitor says in this point there is only allegation against me and the police is going through all evidences. As case work do criminal check and I don't have a criminal record, but will that comes up? I believe the information will be on PNC record as local police intelligence, will the case worker has accessed to this? As my current visa is running out very soon and my solicitor mentioned the case can go on for weeks even months, so I am going to apply now before I overstay and breach immigration law.

Do I need to declare this in my application as there aren't any questions in the application related to my circumstances. If I do declare it, will it affect my application?

criminal offence and are awaiting, or are currently on trial?

E12. Have you ever engaged in any other activities which might
indicate that you may not be considered to be persons of good
character?
(yes or no?)

Will depend on the offense. How severer? Can you give more detail about the offense?

No one knows the internal workings of HO or what a case worker has access to. You do not need to declare this on the form as you are not charged but if this flags up on HO system, your application could be put on hold until the issue is resolved.
