i am also in same situation my ILR was refused and i am stuck with 322(5).AR Failed Reconsideration came with same result.

very unfortunately for me i am in this country since Sept-2006 but have 6 Months and 10 Days gap in 2008.So Ho not counting 2 years so can not submit new LR Application.

I have own house,Dependant 2 years Daughter and family even if HO dont count 2006 to 2008 in this country for 8 years and more.

thoughts are coming from everywhere and long wait and not sure answer is coming from everywhere.

should i go for Human Right?

any gurus and advise??

To me No

i have not,When they ask me to Provide SA302 for that year I provided them and they come back with saying TAX not paid enough.

it was my Mistake as return was done by me (i never had Accountant Hired) when they told me i went to accountant and he found my errors and corrected it and i have clear the outstanding amount and HMRC Accepted the Returns as well before AR Result came.

Any Advise on this Case ?
