Varying to Set (O) then to Set (LR)

Hi
I would really appreciate some idea.

My 10 years will be completed in 5.5 months time.
I have a Tier 1 extension pending since last June 2016.
After almost 1 year of interview home office asking for lots of documents that I do not have most of them so solicitor advising me to Vary to set (o) right after I send whatever documents I have then complete the remaining 5.5 months on set (o) to complete 10 years then vary to Set (LR)

Could anyone share their experience or advise on whether it's a good plan and home office will actually take 5.5 months to make a decision on the varied SEt (o)?

Or shall I wait till the Tier 1 result comes if it's not positive then apply for set (o)? will it break my 10 years? And will I be eligible for SEt(LR) if I take this route?

My immigration history is very clear with just 2 extensions in last 9.5 years

Please advise as I am really worried about it.

Set(O) based on tier 1 Entrepreneur £50k route.

Yes CR001 is right tier 1 Entrepreneur.

Your Tier 1E extension could be refused on the basis of genuineness. A Set(O) will not be successful either and you could be refused within a month or two. This will not enable you to reach the 10 year legally. If your genuineness is not proved, your 10 year long residence could also be affected.
