ILR (Tier 2 Gen) - Confused Salary threshold

Hello everyone,

I’ve ILR application coming up and I’m bit confused about salary threshold for Tier 2 General route.

My history-
1.Tier 2 General - November 2012 (first employer)
2.Tier 2 General - April 2015 (Second employer)
3.Tier 2 General - December 2015 (current employer)

My confusion is how this threshold is calculated by Home office?
Is it based on salary in latest(current) employment?
Is it based on P60s?

My current salary (39,500) is more than required SOC salary.
However, I’m confused about pay mentioned in P60.

P60 - (April 2016-17) - Total pay shown (39,000) (Not a problem)

P60 - (April 2015-2016) - Total pay shown (34,300) (Is it a problem?)

In 2015, I have changed employers twice and my second employer was paying me 35,000 and in April 2015 didn't got any pay as I was changing employment. So in P60 it ended up the amount less than 35k. Do you think this will create an issue in ILR?

Please suggest.

It is a forum rule. It is unfair to the members who offer advice for FREE on the forum, when one person asks questions on the same application under multiple usernames.

You need to earn the minimum of £35,000pa at the time of application and NOT throughout the 5 years.

My previous years pay were way to low so couldn't have met 35k threshold anyway if they would have asked for 5 yrs.

However, my question was, since the rule applies after April 2016, do they consider my annual pay after April 2016 to be 35k or more?

You are misunderstanding the requirement. You need to be earning the monthly equivalent of 35k pa at the time of application. It does not say that you have to be earning that for the whole previous tax year.
