Tier 2 General Sponsorship to ILR (5 years route) [Main and dependants]

Hi I am currently under Tier 2 general sponsored visa from 11 Nov 2012 onwards
My visa was granted for 3+3 years .
First from : 11/11/2012 - 11/11/2015
Second from : 30/10/2015 - 16/11/2018

I am planning to apply for my ILR early January 2018. I have my wife and son as PBS dependents they made entry clearance on 12/09/2013 to UK. Both my dependants have visa until 16/11/2018.

1. Am I eligible for applying now
2. Can my dependants continue on the same visa even if I change to ILR
3. If they stay on the same visa would there be any restriction for their travel outside UK
4. If they continue on the same visa can they go for ILR once 5 years completed by September 2018
5. Could you please guide me to find details about the points 2,3 in UKBA site please
6. If my dependants can’t continue on same visa what would be the option for extension

1. Yes, you were eligible in October already.

2. Yes.

3. No restriction.

4. Depends on what date they ENTERED the UK as PBS dependents. The 5 year residence clock starts from date of entry.

6. Not relevant, see #5.

Hi while filling through the ILR application form I came across section 7 in the application form

Which mentioned the below statement under criminal convictions

"Note: You must give details of all criminal convictions, including spent convictions. This includes convictions for road traffic offences, including drink-driving offences, but not fixed penalty notices (such as speeding or parking tickets)."

Would traffic offence "TS10 Failing to comply with traffic light signals" fall under criminal conviction.
Court was involved in this and it was settled by 3 points in licence and a fine of £300.

The incident happened on 16/04/2012 and the court order on 12/08/2012.

The ILR qualifying visa start from 16th of November 2012.

Do I need to disclose this in the application, if so do I need to provide the details under criminal convictions.

Such fines issued at courts are not convictions in most cases. I suggest to disclose it but it should not have any effect
