UK Born child visa extension while applying ILR for Main applicant

Hi All,

I am going to apply for ILR in couple of weeks as postal application.
I have a dependent child and he born in UK. My child has his Indian passport and BRP card which is valid until Dec 2017.
My Questions are :
1. Do I need to apply for his dependent extension?
2. If my ILR application is delayed, my child visa will expire. Then will it be counted as unlawful stay in UK ?

Initially I thought I don't need to apply extension for my child and I can apply for his Citizenship if my ILR is approved.
One of the solicitor suggests to apply for my child's application as his visa expires and he may be considered that they statyed in UK unlawfully while applying Citizenship.

Please suggest.

Do you plan on registering the child as British once you get ILR??
2. If my ILR application is delayed, my child visa will expire. Then will it be counted as unlawful stay in UK ?
No, the child has an entitlement to register as British.

Hi CR001,

Yes, I planned to apply for his Citizenship once my ILR is approved (as he born in UK).

If my child does NOT have BRP card then he will be fine and he can go to BC once my ILR is approved.
Currently he has BRP card which has expiry date. So will this expiry date considered as unlawful stay in UK ?

For the purpose of citizenship, he will NOT be considered an overstayer.

If you are that concerned, then apply for ILR in person for yourself.

I have a similar case. My Ilr has been approved.my son in Uk born on tier 1 dependent visa. His visa expires in Jan 2018 . What form do I fill for my sons extension.
