Dear,

I will be qualifying for ILR soon as I will be completing 5 years in the UK as a Tier1 Dependent.

I have the following questions regarding the long absence of more than 180 days for Tier1 dependents. I couldn't come back to UK due to pregnancy complications and complication after the birth of my child.

1) Am 4-5 Days short to complete 5 Years when my PBS dependent. visa expires form the first stamping in India Feb 2013 to Visa expiry in Feb 2018? But I can apply 28 days before completing 5 Years. Will this be ok?

2) Do the 5 Years of continuous residence requirement with less than 180 days absence in each year also applies to dependents of the main applicant?

3) The documents and the format which needs to be submitted for consideration with respect to absences for serious and compelling reasons.

I would like to hear the success stories of other users on this board.

Many thanks in advance.

Thanks,
KA

The absence limits do not apply to PBS partners for the periods prior to 11 Jan 2018. However, it's also subject to continuous leave.

Hi vinny many thanks for your reply.

Does continuous leave mean 5 years in UK on the same Visa ?
I applied for my PBS dependent Visa extension in UK before expiry.
