Hi,

Am new to this forum and have found this forum very useful.

Thanks to all for Mod's for your time and effort.

I have a few questions regarding the 2nd leave to remain/ILR process.

When is the earliest date I can apply for ILR?

My understanding is it's 28 dates before date of entry. My spouse entered the country on the 24.03.13 am I right in saying I can apply from the 24.02.18 despite her BRP having a expiry 06/2018. If my understanding is correct and I want to go through Premium centre I can book a date for say around the start of March 2018.

My second question is in regards to the IHS surcharge is my spouse now exempt from this?

I would really appreciate some clarity.

Yes, that's correct understanding. Your wife cocmplete 5 years on 24/March/2018 so she can apply within 28 days.

She can apply on/after Saturday, 24 February 2018

Yes, there is no IHS for ILR.

Another question

Was just reading through the guidance it states.

(a) at least 60 months in the UK with:
(i) leave to enter granted on the basis of entry clearance as a partner granted under paragraph D-ECP.1.1.; or
(ii) limited leave to remain as a partner granted under paragraph D-LTRP.1.1.; or
(iii) a combination of (i) and (ii);

My wife has been out of the country for a total of 160 days over the 5 year period.
Majority of the time spent with me on holiday and visiting family.


Will there be any issues when applying from the 24.02.18 although she hasn't been in the UK continuously for 5 years.

No issue. There is no absence limit for spouse visa holders, provided she did not apply for a new entry clearance visa outside the UK during the 5 years.
