ILR for PBS dependents

Hi,
I'm an ILR holder through Tier 2 ICT route. Got my ILR in Dec 2015.
My wife is still a PBS dependent and is eligible for ILR in Mar 2018. She entered UK in Mar 2013 and we have been extending her VISA in UK and no new entry clearance was obtained from outside of UK. I'm pretty clear about her case.
My son was born in India and we got him to UK as PBS dependent in Oct 2017. He has PBS dependent VISA valid until 2020. I assume he is eligible for ILR at the same time as my wife though he would have been in UK only for around 6 months when my wife applies for ILR.
No rules in 319 (J) state he can't but just wanted to clarify with some experts here.
319J(e) Both of an applicant’s parents must either be lawfully settled in the UK, or being granted indefinite leave to remain at the same time as the applicant, unless
